RENTAL AGREEMENT

[<!DOCTYPE html> <h1 style="text-align: center; font-size: 24px; color: #2c3e50;">Falcon Car Rental Agreement Contract</h1> <p style="margin: 10px 0;">This contract (the <strong>"Contract"</strong>) is made and entered into as of <span style="text-decoration: underline;">_________________</span> by and between Falcon Car Rental (<strong>"Lessor"</strong>) and the Client (<strong>"Client"</strong>).</p> <p style="margin: 10px 0;">WHEREAS, the Lessor is the registered and sole owner of the Vehicle;</p> <p style="margin: 10px 0;">AND WHEREAS, the Lessor and Client have agreed to the letting and hiring respectively of the Leased Vehicle subject to all the provisions, terms, and conditions contained in this Lease;</p> <p style="margin: 10px 0;">AND WHEREAS, the Parties wish to record their Agreement in writing;</p> <p style="margin: 10px 0;">NOW, THEREFORE, the parties mutually agree and it is hereby stated as follows:</p> <h2 style="font-size: 20px; color: #34495e;">1. Definitions and Interpretation</h2> <ul style="list-style: none; padding-left: 0;"> <li style="margin-bottom: 10px;"><strong>1.1.1</strong> "Lessor" shall mean Falcon Car Rentals of car registration no: __________.</li> <li style="margin-bottom: 10px;"><strong>1.1.2</strong> "Client" shall mean the person, natural or juristic, jointly and severally, whose name appears as the Client in the Rental Agreement.</li> <li style="margin-bottom: 10px;"><strong>1.1.3</strong> "Claims Administration Fee" means an administration fee, charged in all instances where a claim needs to be processed in regard to any damage, loss, or theft of the vehicle.</li> <li style="margin-bottom: 10px;"><strong>1.1.4</strong> "Damages" (in relation to the vehicle) means the actual expenditure in towing, transporting, and storing the vehicle, repairing any damage, replacing parts or accessories (without allowing for depreciation), remunerating an expert to inspect the vehicle and report thereon, or any other charges incurred related to an incident of whatsoever nature, including total loss where applicable.</li> <li style="margin-bottom: 10px;"><strong>1.1.5</strong> "Day" means a period of 24 hours (or any part thereof), calculated from the time out as reflected on the Rental Agreement.</li> <!-- More definitions here --> </ul> <h2 style="font-size: 20px; color: #34495e;">2. Standard Rental Rates Include</h2> <ul style="list-style: none; padding-left: 0;"> <li style="margin-bottom: 10px;"><strong>2.1.1</strong> 2000 kilometres per day.</li> <li style="margin-bottom: 10px;"><strong>2.1.2</strong> Standard insurance cover.</li> <li style="margin-bottom: 10px;"><strong>2.1.3</strong> Applicable vehicle registration.</li> <li style="margin-bottom: 10px;"><strong>2.1.4</strong> All applicable taxes in Botswana and/or neighboring countries where the vehicle is taken (if cross-border travel is applicable).</li> </ul> <h2 style="font-size: 20px; color: #34495e;">3. Minimum Rental Period</h2> <p style="margin: 10px 0;"><strong>3.1</strong> Unless otherwise agreed by Falcon Car Rentals, the minimum rental period is 24 hours (One Day), calculated from departure from and return to the base.</p> <p style="margin: 10px 0;"><strong>3.2</strong> The days of vehicle pick-up and drop-off are each counted as full days, regardless of the exact time the vehicle is collected or returned.</p> <p style="margin: 10px 0;"><strong>3.3</strong> Falcon Car Rentals reserves the right to modify the minimum rental period for high-kilometre rentals. Any changes will be confirmed with the Client prior to booking.</p> <h2 style="font-size: 20px; color: #34495e;">4. Booking Deposits and Payment Terms</h2> <p style="margin: 10px 0;">Bookings must be made in advance and are subject to vehicle availability. Full payment is required to reserve the vehicle. Payments can be made by Electronic Funds Transfer (EFT) or via Visa in Botswana Pula (BWP).</p> <h2 style="font-size: 20px; color: #34495e;">5. Vehicle Delivery and Collection</h2> <p style="margin: 10px 0;">Vehicle deliveries and collections between 8:30 AM and 5:30 PM (Monday to Sunday) are included in the rental cost. Collections or deliveries outside of these times may incur additional fees.</p> <h2 style="font-size: 20px; color: #34495e;">6. Conditions of Vehicle Rental</h2> <p style="margin: 10px 0;">The Client must have a valid passport or ID, a valid driver’s license, and provide copies of all necessary documents before receiving the vehicle.</p> <h2 style="font-size: 20px; color: #34495e;">7. Use of Vehicle</h2> <p style="margin: 10px 0;">The vehicle can only be driven on recognized roads by authorized drivers listed in the agreement. The Client must ensure the vehicle is properly secured when not in use.</p> <h2 style="font-size: 20px; color: #34495e;">8. Termination and Cancellation</h2> <p style="margin: 10px 0;">Falcon Car Rentals reserves the right to terminate the agreement at any time. The Client remains responsible for all obligations until the vehicle is returned.</p> <h2 style="font-size: 20px; color: #34495e;">9. Payment Obligations and Indemnification</h2> <p style="margin: 10px 0;">The Client agrees to pay all specified rates, fines, penalties, and expenses incurred during the rental period. The Client indemnifies Falcon Car Rentals against any liability arising from the rental.</p> <h2 style="font-size: 20px; color: #34495e;">10.
